Nursing Home Abuse

Florida law makers have enacted laws in our state concerning how nursing homes must treat their residents.The Zappitell Law Firm takes great pride in representing any individual whose rights have been violated as a result of the actions of any nursing home, it's agents, employees, and/or servants.

Nursing homes must provide the following rights to their residents:

  • The Right to civil and religious liberties
  • The Right to private and uncensored communication
  • The Right tobe fully informed of services available in the facility and of related charges of such services
  • The Right to be adequately informed of his/her medical condition and proposed treatment
  • The Right to refuse medication or treatment
  • The Right to receive adequate and appropriate health care and protective and support services
  • The Right to have privacy in treatment and in caring for personal needs
  • The Right to be treated courteously, fairly and with the fullest measure of dignity
  • The Right to be free of mental and physical abuse, corporal punishment, extended voluntary seclusion and from physical and chemical restraints
  • The Right to freedom of choice in selecting a personal physician
  • The Right to retain and use personal clothing and possessions
  • The Right to have copies of the rules and regulations of the facility
  • The Rightto be informed of the bed reservations policy for a hospitalization and certain rights concerning being transferred or discharged from a facility.

One of the most common violations of these rights is to allow bed sores to develop and fester on certain residents, allow residents to wander and become injured and otherwise not properly caring for nursing home residents. Florida Law provides that a civil action may be commenced to seek money damages for losses as a result of the violation of the aforementioned rights.

Most nursing homes provide wonderful care to their residents and the employees working there are proud to assist the elderly in their last stage of life; unfortunately, there are exceptions.
